Source text - English Retailers have an obligation to supply safe and legal products to their consumers and therefore must take all reasonable precautions and exercise due diligence in the avoidance of failure, whether in the development, manufacture, distribution, advertising or sale of products.
This obligation, in the context of retailer-branded products, involves a number of activities, one of which is the verification of the technical competence of the products' suppliers. For many years, retailers undertook this activity themselves, verifying competence and performance against their own individual, internally developed standards, orthey used third-party inspection bodies. However, with an increased obligation in respect to the EU General Products Safety Regulations 2005 and its implementation from November 2005, with the support of its members the British Retail Consortium (BRC) brought together stakeholder groups to establish the basis for an updated technical standard for consumer products.
With the increasing demand for retailer-branded products, the Standard will help to ensure that products meet consumers' expectations with respect to quality and safety.

BİRİNCİ BÖLÜM
Amaç, Kapsam ve Tanımlar
Amaç ve Kapsam
MADDE 1 – (1) Bu Kanunun amacı; uzmanlık, ileri teknoloji ve yüksek maddî kaynak gerektiren, at yarışları hariç olmak üzere, spor müsabakaları üzerine sabit ihtimalli ve müşterek bahis oyunlarını düzenleme işine ilişkin merkezî bahis sistemi ve risk yönetim merkezinin kurulması ve işletilmesi ile başbayilik iş ve hizmetlerinin özel hukuk sözleşmesi ile hâsılattan pay verilmesi modeliyle, Spor Toto Teşkilat Başkanlığınca özel hukuk tüzel kişilerine yaptırılmasına ilişkin usul ve esasları belirlemektir.
Tanımlar
MADDE 2 – (1) Bu Kanunun uygulanmasında;
a) Başbayi: 3 üncü maddenin (c) bendinde belirtilen iş ve hizmetleri yapmak üzere idare ile sözleşme yapan yükleniciyi,
b) Benzer iş: Risk yönetimi içermesi kaydıyla, ihale konusu iş ile nitelikleri itibarıyla benzerlik gösteren, aynı veya benzer usullerle gerçekleştirilen makine, teçhizat ve diğer ekipman ile malî güç, ihtisas ile personel ve organizasyon gerekleri itibarıyla benzer özellikteki işleri,
c) Hâsılat: İdare tarafından müşterek ve sabit ihtimalli bahis oyunlarının oynatılması karşılığında iştirakçilerden tahsil edilen tutardan katma değer vergisi düşüldükten sonra kalan tutarı,
ç) Hâsılattan pay verilmesi modeli: 3 üncü maddede belirtilen iş ve hizmetlerin özel hukuk tüzel kişilerine yaptırılması için yükleniciye, yüklendiği iş ve hizmetlerden elde edilen hâsılattan, sözleşmede belirlenen esaslara göre yükleniciye belli bir yüzde oranında pay verilmesini öngören özel finansman modelini,
d) İdare: Spor Toto Teşkilat Başkanlığını,
e) İhale dokümanı: İhale konusu iş ve hizmette idarî şartname, teknik şartname, sözleşme tasarısı ve gerekli diğer belge ve bilgileri,
f) İhale yetkilisi: Spor Toto Teşkilat Başkanını,
g) İstekli: İhaleye teklif veren özel hukuk tüzel kişilerini,
ğ) Merkezî bahis sistemi: Ana sistem ve kurtarma sistemi olmak üzere iki bölümden meydana gelen, tüm bayilerden gelen bilgilerin toplandığı, işlendiği ve depolandığı, yüksek kapasite ve işlem gücüne sahip yedekleme özelliği bulunan donanımların bütününün oluşturduğu sistemi,
h) Müşterek bahis oyunları: Yurt içinde ve yurt dışında tertiplenen spor müsabakalarına ait sonuçların tahmin edilmesi üzerine oynatılan, hâsılatın önceden belirlenen ikramiye yüzdesinin, doğru sonucu tahmin eden iştirakçiler arasında paylaştırıldığı bahis oyunlarını,
ı) Ortak girişim: İhaleye katılmak üzere 29/6/1956 tarihli ve 6762 sayılı Türk Ticaret Kanunu hükümlerine göre kurulmuş anonim şirketlerin kendi aralarında veya yabancı şirketlerle yaptıkları anlaşma ile oluşturulan iş ortaklıklarını,
i) Özel hukuk tüzel kişisi: 6762 sayılı Türk Ticaret Kanunu hükümlerine göre kurulmuş anonim şirketleri veya bunların kendi aralarında veya yabancı şirketlerle oluşturdukları ortak girişimleri,
j) Pazarlıkla temin: 26 ncı maddede belirtilen durumlarda 3 üncü maddede belirtilen iş ve hizmetlerin, idare tarafından ilan yapılmaksızın davet edilenlerle teknik şartların ve hâsılattan verilecek pay oranının görüşülerek temin edildiği usulü,
k) Pilot ortak: Ortak girişimi temsil etme yetkisine sahip olan ortağı,
l) Risk Yönetimi: Sabit ihtimalli bahis oyun programlarında yer alan bahis katsayılarının ve asgari müsabaka sayılarının belirlenmesi ile oyunların ikramiye riskinin kısmen veya tamamen yüklenici tarafından karşılanmasını,
m) Risk yönetim merkezi: Sabit ihtimalli bahis oyun programlarında yer alan etkinliklere ilişkin bahis oranlarının belirlenmesi, güncellenmesi ve bahis işlemlerinin takibi gibi faaliyetlerin yürütüldüğü merkezi,
n) Sabit ihtimalli bahis oyunları: Yurt içinde ve yurt dışında tertiplenen spor müsabakalarına ait sonuçların veya etkinliklerin tahmin edilmesi esasına göre oynatılan ve iştirak edenler arasından doğru tahmin edenlere, önceden belirlenen bahis oranlarıyla ikramiye kazandıran oyunları,
o) Sözleşme: İdare ile yüklenici arasında yapılan, özel hukuk hükümlerine tabi sözleşmeyi,
ö) Spor müsabakası: Yurt içinde ve yurt dışında ilgili kurum ve kuruluşlarca tertiplenen resmî, özel, temsilî, ulusal veya uluslararası spor karşılaşmalarını,
p) Teklif: Bu Kanuna göre yapılacak ihalelerde isteklinin İdareye sunduğu ve hasılattan talep ettiği pay oranını gösterir teklifi ile değerlendirmeye esas diğer belge veya bilgileri,
r) Yüklenici: Bu Kanunda belirtilen iş ve hizmetlerin yaptırılması amacıyla İdare ile sözleşme imzalayan özel hukuk tüzel kişisini,
ifade eder.

FIRST SECTION
Objectives, Scope and Definitions
Objectives and Scope
ARTICLE 1 – (1) The purpose of this law is to set down and apply the rules to the establishment and operation of a central betting system and risk management centre concerning the organisation of fixed-odds and sweepstake betting games for sports matches, excluding horse races, requiring expertise, advanced technology and high level financial resources; and to the Football Pools Organisation Directorate (Spor Toto Teşkilat Başkanlığı) having private law legal entities provide the main dealership activities and services based on the model of giving shares in revenues via private law contracts.
Definitions
ARTICLE 2 – (1) For the purposes of this law;
a) “Main dealer” shall refer to the Contractor signing a contract with the Contracting Authority for the provision of the activities and services specified in paragraph (c) of Article 3;
b) “Similar activities” shall refer to those activities that share similar characteristics with those covered by the tender; that are performed by the same or similar procedures and that have similar requirements in terms of machines, equipment, financial power, expertise, personnel and organisation.
c) “Revenues” shall refer to the amounts remaining after the Contracting Authority deducts VAT from the amounts collected from participants in return for their operation of fixed-odds and sweepstake betting games;
d) “Model of giving shares in revenues” shall refer to the financing model providing for the giving to the Contractor a certain percentage from the revenues obtained from the activities and services performed by the Contractor in accordance with the provisions of the Contract, in return for their provision of the activities and services specified in Article 3 by private law legal entities;
e) “The Contracting Authority” shall refer to the Football Pools Organisation Directorate.
f) “Tender documents” shall refer to both administrative and technical specifications, draft contracts and other documents and information required in respect of the activities and services covered by the tender.
g) “The Contracting Officer” shall refer to the Director of the Football Pools Organisation Directorate.
h) “Bidder” shall refer to the private law legal entities bidding for the tender.
i) “Central betting system” shall refer to the system comprising two parts; namely, the main system and the recovery system, including all hardware, collecting, processing and storing of information received from all dealers, along with back-up features and having a high capacity and processing capability.
j) “Sweepstake betting games” shall refer to betting games where the players predict the results of sports matches organised in both Turkey and abroad, and where a predetermined percentage of the revenues is distributed among the participants whose predictions are correct.
k) “Joint venture” shall refer to the business partnerships that joint stock companies incorporated pursuant to Turkish Commercial Code no. 6762 of 29.06.1956, either formed between themselves or with foreign companies, with a view to bid for the tender.
l) “Private law legal entity” shall refer to joint stock companies incorporated pursuant to the provisions of Turkish Commercial Code no. 6762, or any joint venture that these companies establish between themselves or with foreign companies.
m) “Negotiated procedure” shall refer to the procedure of procurement where, in cases specified in Article 26, the Contracting Authority procures the activities and services specified in Article 3 by way of negotiating the technical specifications and the percentages of revenues with the parties invited without a tendering procedure.
n) “Lead partner” shall refer to the partner authorised to represent the joint venture.
o) “Risk Management” shall refer to the determination of betting quotients and the minimum number of matches appearing in the fixed-odds betting game programmes, as well as the Contractor’s assuming any prize risks of the games in part or whole;
p) “Risk management centre” shall refer to the centre responsible for determining and updating the stakes for the activities included in the fixed-odds betting game programmes and following up the betting operations;
q) “Fixed-odds betting games” shall refer to such betting games where players predict the results of sports matches or contests organized in both Turkey and foreign countries and where participants making the correct prediction win prizes based on predetermined stakes.
r) “Contract” shall refer to the Contract made between the Contracting Authority and the Contractor, subject to the provisions of private law.
s) “Sports match” shall refer to official, private, friendly, national or international sports matches organised by the relevant associations and organisations both in Turkey and abroad.
t) “Bid” shall refer to the bid submitted by bidders to the Contracting Authority for tenders to be distributed in accordance to the Law referring to bidders demanding a share in the revenues, and to other documents or information to be considered in evaluating the bid.
u) “Contractor” shall refer to the private law legal entity to sign a contract with the Contracting Authority for their performance and provision of the activities and services specified herein.
