الضرر الموجب للطلاق هو ذلك الذي يطلب بسببه الطرف المتضرر الطلاق (عنف جسدي أو لفظي، إهمال...) ويمكن إثباته باعتباره واقعة قانونية بجميع وسائل الإثبات المعتمدة قانونا وفي هذا المجال، تطبّق قاعدة "البيّنة على من ادّعى"، أي أن الذي يدعي أمرا عليه أن يثبته إذ لا تكتفي المحكمة بمجرد أقواله. وبإمكان المدّعى عليه مناقشة الحجج المقدّمة والإتيان بما يخالفها أو بما يضعفها.

In order to establish the grounds necessary for fault-based divorce, there must be a showing that one party has acted wrongfully and caused the breakdown of the marriage. In order for a divorce to be granted, there has to be evidence presented sufficient to establish that the wrongdoing has occurred and one party was therefore at fault.

Some acts that constitute grounds for fault-based divorce include adultery, physical or mental abuse, conviction of a felony, or abandonment.
