I would say this term here refers to a crime to which applies the incapacity to become statute-barred or maybe it would also be possible to say "not subject to the statute of limitations"

: Your first suggestion is not really English. Your second seems odd. It reads to me as if this crime is subject to a/the statute of limitations, but that the time has not yet expired.
