“Yielding up” is the tenant’s obligation to deliver the premises back to the Landlord at the end of the lease. It is a key consideration in entering in to lease: thinking about the process of leaving the premises and the state of repair of the building on leaving. “Re-instatement” the tenant’s obligation to remove alterations and improvements at the end of the lease

The ‘yield up’ provision is present in most commercial leases and is generally seen to be a ‘catch-all’ clause to ensure the premises are handed back to the Landlord in a satisfactory condition. As well as ensuring vacant possession, this clause usually reiterates the more specific covenants detailed above, possibly with further embellishments.

Where acting for Landlords, we pay careful attention to this covenant and to the other related covenants in order to notify the Tenant of their required duties.

: This is not about leaving the premises. It is about leaving a shared resource in shape for the next user, and the one doing the leavign behind is in line to use the resource again himself, according to some schedule.
