I have scaled back 50 percent contingent fees for minors but not in a case like this and agree with the factual proposition that a medical malpractice case ***is a pretty chancy thing and you are going to try a lot that you will lose**** and I think people who represent Plaintiffs in this line of work are entitled to earn a reasonable living, which only can be done through a fee at about this level, and consequently those are reasonable for this kind of case even though they may not be for other kinds of cases.
I would also like to know how to translate "scale back" in this context. Thanks a lot!

This is one of those "shady" legal sentences that can be understood in more than one way. What I understand is that the lawyer is defending his quote, in which he already reduced (scaled back) contingent fees for minors. However, being a medical malpractice case, means that he will have to try a lot (tactics, perspectives, arguments) that may put at risk his reputation (perhaps lose credibility) and therefore he must bill accordingly.

I think "try" has here the basic legal meaning of being put on trial, it says that as in these kinds of cases chance has a lot to do with wining or losing, the fees have to be reasonable but not too low -they talk about scaling down, as in reducing those fees in other cases. It is a simple case of trying to justify their fees.

My Spanish rendering may not be perfect but I am sure about the English meaning. The writer is saying that it is very hard (chancy=incierto)to prosecute a medical malpractice case, therefore a trial attorney will try many cases (to try=procesar) but will lose more than s/he wins, and so find it hard to make a living.
