: Tak najczęściej w tekstach paralelnych aktów prawnych Unii Europejskiej (w tym dotyczących ENA i ekstradycji) - choć nawet w nich jest dużo rozbieżności. A „detention” - raczej jako zatrzymanie i środek zabezpieczający.

Kontekst jest trochę rozjechany, bo w jednym miejscu mówi się o pozbawieniu wolności w czasie postępowania (czyli zatrzymania a potem ewentualnie zastosowania aresztu - wtedy będzie detention), a w innym (wpis askera w dyskusji) o karze pozbawienia wolności, czyli już imprisonment (kpw to przykład eufemizmu w języku kodeksu, żeby nie mówić o więzieniu - choć o to chodzi). IMO kontekst podany przy zadawaniu pytania to jednak i tak detention (tego dotyczą podane przykłady), a dopiero we wpisie z dyskusji mamy imprisonment.
2. czy w tym okresie była wobec niego wykonywana kara pozbawienia wolności w innej sprawie.
I dalej:
Zgodnie z prawem polskim jest możliwe zaliczenie okresu pozbawienia wolności skazanego za granicą w związku z postępowaniem ekstradycyjnym lub o wykonanie europejskiego nakazu aresztowania, o ile w czasie tego pozbawienia wolności nie była wobec skazanego wykonywana kara pozbawienia wolności w innej sprawie.
Przyznaję, że ten powyższy jest znacznie lepszy - tłumaczmy:
Aresztowanie... zatrzymuje osobę przez pozbawienie jej wolności...
A skoro pytanie jest o "pozbawiony wolności", a nie o "aresztowany", czy "zatrzymany", to wniosek nasuwa się sam...
