Si le défunt a désigné un exécuteur testamentaire, ce dernier est compétent pour administrer et liquider la succession. Dans le cas où le défunt n’a pas désigné d’exécuteur testamentaire, le tribunal désigne un administrateur en suivant une hiérarchie de bénéficiaires prévue par la loi. Toute personne majeure ayant la capacité juridique, y compris les héritiers légaux ou les légataires, peut être nommée exécuteur.
Les représentants personnels (« personal representatives ») (exécuteur ou administrateur) ne peuvent agir sans lettre successorale.
Ce document est appelé « grant of probate », si l’exécuteur testamentaire a été désigné par le testateur dans son testament.
Il porte le nom de « grant of administration », si l’administrateur successoral a été désigné par le tribunal compétent (« probate court »).
