1. Sequence of presentations and cross examination of experts: the Respondent proposes to have short presentations of the Claimant's experts and of the Respondent's expert (for a maximum of 30 minutes per party) followed by the cross-examination of the Claimant's experts and then, the cross-examination of the Respondent's expert, as reflected in the Hearing Timetable in the Hearing Protocol attached. For both the presentations and the cross- examinations. the Respondent agrees with dealing with the technical matters before dealing with the quantum matters. However, the Claimant proposes to have the presentation of each of the experts immediately followed by the cross-examination of that expert to avoid the attendance of experts on different days and to allow the Sole Arbitrator to hear the cross-examination of an expert when the subject covered by that expert in his presentation is still fresh in his mind. By contrast, the Respondent's position is that it would be to the benefit of the Sole Arbitrator to hear all the experts' presentations first, allowing the Sole Arbitrator to consider all the matters addressed by both Parties' experts before the cross-examinations of the experts take place.
