Diferencias entre la propiedad horizontal y la propiedad vertical
Mientras en la propiedad horizontal existe un derecho de pertenencia singular y exclusivo sobre elementos privativos propios, así como una cuota de propiedad determinada sobre elementos comunes, en la vertical es una propiedad única la que tiene la pertenencia de las diferentes viviendas o locales que componen el inmueble.
En este caso, el procedimiento más común es que el titular busque rentabilizar el edificio mediante su arrendamiento para algún fin concreto (comercial, profesional, cultural, recreativo…). Por tanto, en la propiedad vertical no se constituye una comunidad de propietarios, pero los dueños deben conservar el inmueble en buen estado y atender las obligaciones administrativas y fiscales correspondientes.
Para ejemplificarlo de un modo más sencillo, la propiedad horizontal se aplica en edificios que cuenten con viviendas particulares, como una comunidad de vecinos, mientras que la propiedad vertical atañe a un inmueble que pertenece a un único propietario, como un hotel, por ejemplo.

Paradoxically, the Spanish Civil Code doesn´t define "propiedad vertical", as far as I know, I don´t know exactly why. This term was surely unknown and therefore not used when the Civil Code was first published. We shouldn´t forget that the original version of the Spanish Civil Code came into force back in 1889!
Article 396 of our Civil Code describes the better known "propiedad horizontal", corresponding to the US condominium, the English and Welsh commonhold, but without mentioning the term “propiedad horizontal”, an expression probably coined much later.
