Teks sumber - Vietnam Năm 1993, chính phủ đã đưa ra hai nghị định nhằm giải quyết tình trạng gia tăng mại dâm và ma túy bằng các trung tâm cai nghiện. Đến điều 199 của bộ luật hình sự 1999 thì hành vi sử dụng ma túy đã chính thức bị coi là tội phạm[1]. Tuy nhiên, một loạt thay đổi chính sách quan trọng đã diễn ra trong suốt một vài năm vừa qua. Năm 2004, Thủ tướng chính phủ đã phê duyệt chiến lược quốc gia về lĩnh vực phòng chống ma túy bao gồm 9 lĩnh vực hành động trong đó đặc biệt đề cập đến việc trao đổi bơm kim tiêm và bao cao su. Năm 2006, quốc hội thông qua luật phòng chống và kiểm soát HIV/AIDS[9] và nghị định 108/2007 hướng dẫn thi hành luật này thì các hoạt động giảm hại cho người sử dụng ma túy chính thức được ủng hộ chương trình giảm hại[16]. Luật ma túy 2000 được thay thế bằng luật sửa đổi bổ sung một số điều của luật phòng chống ma túy năm 2008 đề cập tới công ước quốc tế cho rằng người sử dụng ma túy không nên bị coi là tội phạm[10,11]. Kết quả là bộ luật hình sự 2009 đã chính thức bỏ điều 199 này[12]. Từ sau Đổi mới, dễ nhận thấy “những nỗ lực kiểm soát HIV/AIDS ở Việt Nam có liên quan chặt chẽ đến chủ trương đấu tranh phòng, chống tệ nạn xã hội của chính phủ” [35] mà ma túy là một vấn đề trọng tâm. Trước khi HIV xuất hiện ở Việt Nam, vấn đề ma túy đã được chính phủ đặc biệt quan tâm. Từ khi dịch HIV bùng nổ vào giữa những năm 1990, câu chuyện về ma túy ở Việt Nam có thêm sắc thái mới. Và gần đây, các chính sách giảm tác hại đã lần lượt ra đời trong bối cảnh đan xen với những nỗ lực phòng chống ma túy, điều này đôi khi dẫn đến những mâu thuẫn trong việc triển khai các hoạt động giảm tác hại. Sự thay đổi chính sách và sự chuyển đổi nhanh chóng sang chính sách giảm hại đã dấy lên câu hỏi làm thế nào để chuyển đổi đó diễn ra và làm thế nào để chính sách mới đó được áp dụng.
Penerjemahan - Inggris In 1993, two decrees were approved by Vietnam’s government in order to tackle the upward trend of prostitution and drug abuse by building rehabilitation centers. It was not until the birth of article 199 of the criminal law 1999 that drug abuse is officially referred to as a crime. However, Vietnam has undergone a series of significant policy changes for the past years. In 2004, the Prime Minister approved a national strategy on drug prevention, involving nine sessions, where sharing needles and syringes, and condom use are paid special attention. In 2006, when Vietnam’s National Assembly adopted the law on HIV/AIDS prevention and control and Decree 108/2007 regarding the enforcement of this law, harm reduction activities targeting at drug users were officially supported by reduction programs. The drug prevention law 2000 was in place of another one issued in 2008, with some modifications and additions, addressing the international convention that drug abusers should not be regarded as criminals. And the removal of article 199 was officially confirmed by the adoption of the 2009 criminal law. After the Reformation period, it is clearly seen that “the effort to control HIV/AIDS in Vietnam is closely associated with the government’s guideline on social evil prevention”; drug abuse prevention is of great importance and a priority. Prior to HIV striking Vietnam, drug abuse has been of the government’s grave concern. Since the outbreak of HIV epidemic in the mid 1990s, the storyline of HIV in Vietnam has experienced new details. Recently, there has witnessed the subsequent births of harm reduction policies when the effort of drug prevention is still underway, challenging the launch of harm reduction activities. Policy changes and the dramatic transition to harm reduction policy raise two questions: one is how to induce that transition, and the other is what should be done to ensure that the new policy is successfully applied.
