Teks sumber - Inggris ARTICLE 3. DELIVERY & INSPECTION
3.1 Unless expressly agreed otherwise by the Parties, the Parties agree that all Product shall be delivered on the basis of DAP Bandung, Indonesia.
3.2 The Supplier shall make all commercially reasonable endeavors to cause the shipment of the Product by the date specified in the Purchase Order. The date on which a bill of lading is issued shall be considered as the date of shipment. Unless expressly agreed otherwise by the Parties, the Supplier may select at its sole discretion the port of shipment for the ordered Product and may effect delivery by making one or more installment shipment and/or transshipment. In case the required shipment for the ordered Product is delayed due to the delay in sailing schedule of the relevant ship designated by the Purchaser, the Supplier shall not be liable for such delay in shipment and delivery of the Products.
3.3 From the shipment of the ordered Products until the deliver thereof to the Purchaser’s place stipulated in Section 3.1, all of such Products shipped shall be insured with a reputable company to at least the amount equivalent to 110% of the invoiced price for such Products against all risks (including without limitation war, strike, theft, fire, flood, storm and accidental or malicious damages). The Parties agree that any amount or value covered by or indicated in such insurance policy shall be denominated in the United States Dollar.
Penerjemahan - Indonesia PASAL 3. PENGIRIMAN & INSPEKSI
3.1 Kecuali secara jelas disetujui oleh kedua belah pihak, Pihak-Pihak setuju bahwa semua Produk akan dikirim berdasarkan DAP Bandung, Indonesia.
3.2 Pemasok akan melakukan segala upaya yang wajar secara komersial untuk menepati jadwal pengapalan Produk sesuai tanggal yang disebutkan di dalam Pesanan Pembelian. Tanggal di mana bill of lading dikeluarkan akan dianggap sebagai tanggal pengapalan. Kecuali secara jelas disetujui oleh Pihak-Pihak, Pemasok boleh memilih atas kebijakannya sendiri pelabuhan pengapalan untuk Produk yang dipesan dan boleh menjalankan pengiriman dengan membuat satu atau lebih installment shipment dan/atau transshipment. Apabila pengapalan yang dibutuhkan untuk Produk yang dipesan terlambat karena penundaan jadwal berlayar dari kapal yang ditunjuk oleh Pembeli, Pemasok tidak akan bertanggung jawab untuk keterlambatan pengapalan dan pengiriman Produk itu.
3.3 Dari pengapalan Produk yang dipesan sampai pengiriman daripadanya ke tempat Pembeli yang ditetapkan di Bagian 3.1, semua Produk yang dikapalkan tersebut akan diasuransikan pada perusahaan yang terkemuka untuk setidaknya jumlah yang sama dengan 110% dari harga invoice untuk Produk tersebut terhadap segala resiko (termasuk tanpa batasan perang, pemogokan, pencurian, kebakaran, kebanjiran, badai dan kerusakan yang terjadi secara sengaja atau tidak sengaja). Pihak-Pihak menyetujui bahwa berapapun jumlah atau nilai yang ditanggung oleh atau diindikasikan dalam polis asuransi akan dalam mata uang Dollar Amerika.
